National identity and attachment to national culture have taken root even in this era of globalization. National sentiments find expression in multiple political spheres and cause troubles of various kinds in many societies, both domestically and across state borders. Some of these problems are rooted in history; others are the result of massive global immigration. As US Secretary of State John Kerry tries to broker a new round of Israel-Palestine peace talks, the Israeli government continues expanding its settlements in disputed (...) territories. As this proposal is being written, Japanese citizens are debating whether their politicians should visit the Yasukuni Shrine (靖國神社), where the spirits of fourteen Class A war criminals from WWII and more than one thousand others convicted of war crimes by the International Military Tribunal for the Far East are honored with a distinguished resting place. As the Chinese government’s plan to bring economic prosperity to the Xinjian province unfolds, ethnic conflicts between Han Chinese and local Uyghur Muslims intensify. Tibetans still demonstrate to the Chinese government, some through the dramatic sacrifice of self-immolation, their determination to pursue a Tibet that is truly free and autonomous. The recent inflow of Muslim immigrants across Europa and North America forces those liberal democratic societies to rethink the meaning of multiculturalism. Should the state respect Muslim women’s freedom to wear burkas in public? What about other aspects of certain Muslim traditions such as arranged marriages or the honor killing of teenage girls who see boys their parents do not approve? Since these immigrants voluntarily moved from their homeland to a new society, do they have a duty to give up such practices, which conflict with their new societies’ fundamental commitment to individual autonomy? Eric Hobsbawm suggests that nationalism is a contingent phenomenon in history—it arises with important historical events such as industrialization and print journalism; eventually, it will disappear. Anthony Smith, on the other hand, argues that nationalism is deeply rooted in the human need for collective faith and dignity. How should we understand today’s nationalism? Is it a transient phenomenon that eventually will be eradicated from the world, or is it a timeless issue that confronts and will remain a challenge for every society? Is the conventional distinction between civic and cultural nationalism still relevant or helpful? The problems and ongoing challenges of nationalism are very much alive throughout East Asia where the myth of ethnically and culturally homogeneous nations is still paramount. In addition to the examples provided above, East Asian societies are increasingly multicultural, inevitably forcing their governments to come up with new immigration and border-control policies, revisit their laws regarding labor policies, sociopolitical discrimination, socioeconomic welfare, and, more fundamentally, rethink the constitutional make-up of the citizenry and the ideal of social harmony, one of their most cherished political values. Nevertheless, contemporary theoretical analyses, whether philosophical or empirical, of the phenomena surrounding nationalism, in all its forms, are almost exclusively focused on cases in western cultures and societies, preventing the East Asian people from developing a coherent idea of who they are or should be in a way that can track their deeply-held values and norms (such as Confucianism). One of the primary aims of this conference therefore is to address this ongoing neglect and explore new concepts and theories that are socially relevant in East Asia. Not only will this provide access to the particular experiences of nation, citizenship, and nationalism throughout East Asia but it will bring to bear philosophical concepts, approaches, and styles of reasoning about them that currently are not part of this critical debate. Providing an opportunity to hear these distinct and different East Asian voices and opening up these conceptual and methodological resources to scholars around the world will greatly advance the understanding and appreciation of nationalism. In addition to this primary aim, the proposed conference will achieve two other, novel, and important goals. First, by design, it will bring to bear a multi and interdisciplinary approach to the problems of nationalism. We are not privileging either conceptual or empirical studies in the organization of our conference and will bring together philosophers, political scientists, sociologists, and historians, making every effort to invite scholars who explicitly employ or are interested in exploring different and at times hybrid approaches. Second, we will draw together scholars from around the world: China, South Korea, Japan, Taiwan, North America, and Europe, including leading figures in the field, who will serve as keynote speakers for the conference. Combining these two additional goals will enable us to organize a uniquely diverse conference, both in terms of intellectual discipline and national origin. Along with our primary aim of introducing East Asian voices and theories, this will make our event original, distinctive, and unprecedented in value. Our age is one in which it is unavoidable for people of different cultural backgrounds to live together in many different places. For the sake of justice and stability, a comprehensive re-examination of nationalism is both urgent and necessary. (shrink)

Since the 1990’s the rise of China provokes heated debates in the West. Numerous politicians and scholars, who study contemporary political affairs, pose the question, which will be the new role of China in international affairs? Many Western observers presume that China will act as the Western powers did in the past, promoting policy of domination, enslavement and gaining profits at all costs. The Chinese declarations on peace, co-operation, mutual interests, and harmony are often considered empty words, a certain (...) decorum of “real politics”, as it had been often practised in the West. An inquiry into the Chinese political and intellectual traditions, almost unknown in the West, challenges such widespread opinions and fears. Of course, it is an open question to which degree the traditional Chinese concepts will determine contemporary policy, since China had been westernised in enormous degree.Nevertheless, attitude to war, struggle, and competition constitutes one of the principal characteristics of each culture and appears closely related to its structure of values. Such attitudes determine political concepts and systems, foreign relations, norms of social life, etc. The analysis of Western and Chinese civilisations demonstrates that in this respect they represented divergent orientations. In Erich Fromm’s typology of societies, the Chinese culture could be considered non-destructive but aggressive, whereas Western civilisation could be called aggressive and destructiveOf course, there were great differences both within Chinese and within Western civilisations. Local/regional cultures belonging to each of them had their own characteristics in respect to struggle, and one could also notice great changes in the course of their histories. In general, at the dawn of these two civilisations, both of them were more or less bellicose, although in the cultures of the Chinese Central Plain “avoiding struggle” traits could be detected quite early. Appreciation of peace and harmony eventually prevailed with the predomination of the Confucian ideology, although Taoism and other schools of thought also condemned struggle and war. On the other hand, in the Mediterranean the bellicose cultures and war-mongering states prevailed. The beginning of this “great divergence” could approximately be dated for the middle of the 1st millennium BC, and the civilisations of East Asia and Europe took the opposite courses in theirsocial and political development. Struggle constituted a fundamental principle in the Western vision of the world-order, and its crucial archetype constituted the eternal struggle of Evil against Good, with the eventual triumph of God, who embodies Good and forces of Light. The Chinese tradition promoted instead the vision of the universe as one giant organism based on the principle of harmony, where Yin complements Yang. Hence both civilisations adopted the dualistic concepts, but one was antagonistic, and the second—complementary.In the 19th century, when Asian nations faced the colonial conquests, many of them tried to protect their independence and modernise themselves. For this end they tried to adopt not only Western armaments and military skills, but also Western bellicose ideology and values. Japan was obviously the champion of such a militarist course, but there were similar tendencies in China as well. Such bellicose ideology reached its apex there during the famous Maoist Cultural Revolution, when class struggle and bellicosity was exalted. The triumph of the Western bellicose approach and rejection of the traditional native heritage marked the century 1860’s–1960’s in China. However, after the unimaginable sufferings of the World War I and II, of Nazism and of communism, the West started to revalidate its traditions condemning war and violence. People started to appreciate peace and co-operation within and among nations. The United Nations and the European Union had been founded for such purposes: to promote peace and co-operation. However, the condemnation of wars did not halt military confrontation of the states, and the West still cultivates political ideologies, which propagate the “proper order” based on competition and struggle. Hence the concepts of multi-party democracy and of free market could serve as hallmarks of the West. In China, since the end of the 1970’s step by step the ancient ideological traditions have been appreciated again and the new concepts of peaceful and harmonious development evolved. At the beginning of the 21st century the Chinese leaders elaborated a new ideology of both harmonious domestic and international order aiming at peaceful development based on co-operation. Of course, there are still vivid the remnants of the previous Western-type approach of the brutal competition and of aggressive foreign policy.Notwithstanding divergent tendencies inside each of these civilisations, in general they both approach each other again, but this time in a common search for peace, cooperation and harmonious development. Their interpretations obviously differ, since in China such concepts are traditional, but rather new in the West, and in various respects both sides have different values and ideals. (shrink)

How can people from diverse and different cultural backgrounds balance and reconcile their autonomous cultural identity with the universal dictates of the global age? My approach to this question is from an East Asian perspective, in particular by addressing the issue of 'Confucian cultural identity' under four broad topics: (1) the truth and falsehood of the discourse on 'Asian Values' and 'Confucian-style Capitalism'; (2) the spread of modern science and the tragic consequences of 'Instrumental Reason'; (3) criticism of instrumental (...) reason and its encounter with Confucian virtue ethics; and (4) a reassessment of the 'Anthropocosmic Moral Metaphysics' of (Neo-) Confucianism. In conclusion, on the impending demand to cope with the crisis of our cultural identity in the age of globalisation, our project to strive for the viability of Confucian humanism in the age of globalisation, I think, should mean no other than the invocation of care-ethics that takes care of our alienated neighbours on the one hand and a thrust of an eco-friendly world view to the anthropocentric hegemony over nature, which has been appreciated by 'modern' men since the Enlightenment, on the other hand. East Asia’s economy is leading the world into the new Asian century. While meritocratic practices in the educational and private sectors are often considered pivotal conditions for East Asia’s economic success, experts have pointed out that the path ahead requires new approaches to ensure social cohesion and stability, which depend on the quality of relations across social divides. These considerations raise multiple questions for philosophers: What forms of social meritocracy are necessary to sustain social cohesion? Moreover, (...) how can the detrimental effects of meritocratic practices be contained? Is it possible to utilise some of the intellectual resources indigenous to East Asia to generate innovative solutions? This paper argues that the answers to these questions lie in the indigenous Confucian conceptual resources. Confucian ideas can inspire a more desirable societal ideal for the future of East Asia. In particular, the Confucian emphasis on cultivating reciprocal harmonious human relationships and others’ morality can guide new approaches to fostering social cohesion. As Confucian personal cultivation through harmonious relations is a process of social cohesion, these ideas inspire a) a multiple approach to policymaking that is not only grounded in economic redistribution, b) a richer understanding of societal progress, and c) a democratic approach to fostering social cohesion. Unlike Confucian meritocrats and scholars who defend the Confucian roots of East Asian forms of political and social meritocracy, this paper proves that Confucian conceptual resources can help formulate a societal vision that strengthens cohesion and mitigates the adverse effects of meritocratic practices. Harmony as a basic value is neglected in internationally influential philosophical discussions about rights, power, and other facets of public policy; it is not prominent in articles that appear in widely read journals or in books published by presses with a global reach. Of particular interest, political philosophers and policy makers remain ignorant of the similarities and differences between various harmony-oriented approaches to institutional choice from around the world. In this chapter, I begin to rectify these deficiencies by (...) critically discussing the way harmony has figured into political philosophies from three major traditions in the Global South, namely, African ubuntu, East Asian Confucianism, and South American buen vivir. I point out that, although harmony is at the core of all three political philosophies, it is conceived in different ways, entailing incompatible prescriptions about things such as who should make laws and which sorts of beings have rights against the state. Such contrasting views call for rigorous cross-cultural dialogue amongst theorists of harmony, beyond mounting challenges to more individualist approaches that have been salient in modern Western political thought. The Editors have taken great care so that a continuity and a coherence of presentation is achieved despite the striking variety of perspectives from which harmony and strife are analyzed. It is both unusual and important to have such a systematic and thorough investigation of a topic of paramount social and philosophical significance by some of the leading minds of the day. Harmony has become a major challenge for modern governance in the twenty-first century because of the multi-religious, multi-racial and multi-ethnic character of our increasingly globalized societies. Governments all over the world are facing growing pressure to integrate the many diverse elements and subcultures which make up modern pluralistic societies. This book examines the idea of harmony, and its place in politics and governance, both in theory and practice, in Asia, the West and elsewhere. It explores and analyses (...) the meanings, mechanisms, dimensions and methodologies of harmony as a normative political ideal in both Western and Asian philosophical traditions. The book argues that in Western political thought - which sees politics as primarily concerned with resolving social conflicts and protecting individual rights - the concept of harmony has often been neglected. In contrast, since earliest times harmony or ‘he’ has been a profound theme in Confucian thought, and current leaders of many East Asian governments, and the Chinese government, have explicitly declared that the realisation of a harmonious society is their aim. The book also assesses how harmony is pursued, jeopardized or deformed in the real world of politics, based upon empirical analysis of a variety of different cultural, social and political contexts, including: China, Hong Kong, Singapore, Malaysia, Singapore, Vietnam, Denmark, Latin America and the Scandinavian countries. It shows how harmony as an organizing concept can help to promote new thinking in governance, and overcome problems of modern-day governance like distrust, adversarial conflicts, hyper-individualism, coercive state intervention, and free-market alienation. Harmony is a concept essential to Confucianism and to the way of life of past and present people in East Asia. Integrating methods of textual exegesis, historical investigation, comparative analysis, and philosophical argumentation, this book presents a comprehensive treatment of the Confucian philosophy of harmony. The book traces the roots of the concept to antiquity, examines its subsequent development, and explicates its theoretical and practical significance for the contemporary world. This paper reports the results of a survey of 842 undergraduate business students in four nations - the United States of America, the Peoples' Republic of China, Japan, and the Republic of Korea. This survey asked students to respond to four scenarios with potentially unethical business behavior and a string of questions related to the importance of ethics in business strategy and in personal behaviors. Based on arguments related to differences in recent historical experiences, the authors suggest that student responses (...) may be as different within the East Asian environment as they are between this environment as a whole and the USA. Survey results indicate a greater perception of ethical problems and more importance placed on ethics per se in business practices, as well as less of an emphasis on social harmony on the part of USA students. At the same time, substantial national differences in response are also witnessed within the set of East Asian students. A priori expectations as to the manner in which these East Asian responses should vary based on differences in recent historical experiences are partially, but not fully, supported. The authors argue that the key value of the reported research rests on a demonstration that national differences within a common cultural area can be as great as differences across cultural areas and that practitioners of global business must fine-tune their expectations as to acceptable business and personal actions to accommodate specific national historical experiences to be effective. As both Chinese philosophy and Indian philosophy have been largely marginalized on the world stage of philosophy in contemporary times, there is a pressing need to bring these voices into the discourse of world philosophy. This essay explores the value of taking into account the Confucian idea of harmony for postcolonial solitary and for a more equitable polycentric global academy. I explicate the concept and the value of harmony as exemplified in Confucian philosophy. I examine reasons of the (...) disappearance of harmony in dominant Western philosophical discourse by comparing various conceptions of harmony in the West. Greek philosophers Heraclitus, Pythagoras, and Plato presented competing conceptions of harmony; whereas Heraclitian processive harmony presupposes opposites, tension and conflict, Pythagorean harmony and Platonic harmony are founded on a pre-determined order. In the contemporary West, from Karl Popper to Martha Nussbaum, harmony has been treated with disdain while it is taken in a Platonic sense. In East Asia, both Confucianism and Daoism take harmony/harmonization as an effective way to accommodate diversity and difference. I will then focus on the Confucian dynamic notion of “harmony with difference” and argue that such a conception is far from naiveté and it has important implications if it is taken seriously in contemporary philosophical discourse. We provide new findings that add to the growing body of empirical evidence that important epistemic intuitions converge across cultures. Specifically, we selected three recent studies conducted in the US that reported surprising effects of knowledge attribution among English speakers. We translated the vignettes used in those studies into Mandarin Chinese and Korean and then ran the studies with participants in Mainland China, Taiwan, and South Korea. We found that, strikingly, all three of the effects first obtained in the US (...) also emerged in the East Asian cultures we studied. Our findings not only cohere with but also provide—at least moderate—support for the existence of extensive convergences of important epistemic intuitions across cultures. (shrink)

This book contributes to both the internal debate in liberalism and the application of political liberalism to the process of democratization in East Asia. Beyond John Rawls’ original intention to limit the scope of political liberalism to only existing and well-ordered liberal democracies, political liberalism has the potential to inspire and contribute to democratic establishment and maintenance in East Asia. Specifically, the book has two main objectives. First, it will demonstrate that political liberalism offers the most (...) promising vision for liberal democracy, and it can be defended against contemporary perfectionist objections. Second, it will show that perfectionist approaches to political Confucianism suffer from practical and theoretical difficulties. Instead, an alternative model of democracy inspired by political liberalism will be explored in order to achieve a multivariate structure for citizens to come to terms with democracy in their own ways, to support a neutral state that ensures the establishment and stability of democracy, and to maintain an active public role for Confucianism to prevent it from being banished to the private sphere. In recent years, institutional financial institutions such as the World Bank have taken a keen interest in the links between governance and economic development in East Asia and in other regions of the world. However, the concept of governance has proven difficult to measure in cross-national studies and its meaning in the minds of citizens and experts may differ noticeably. This article examines elite and mass perceptions of governance using the World Governance Indicators developed by scholars affiliated with (...) the World Bank and survey data derived from the 2006 wave of the AsiaBarometer Survey conducted in seven societies. The results of the analysis capture considerable variation at the country and individual levels for how citizens and experts perceive governance in this region of the world. In addition, a multivariate test uncovered some convergence between citizen and expert assessments but only for some of the various governance components. (shrink)

It is still working well and benefit Chengdu Plain nowadays while other comparable water conservancy projects of the same or later age have vanished and been forgotten. More than just a world-famous cultural heritage, it shows the harmonious relationship between man and nature. And it also reveals us how to solve problems in the era of economic (...) globalization, such as the constantly silt up of the dams, the exhaustion of the energy and the crisis of the deterioration of ecosystem. The inspirations it gives us range from technology to humanities, from economy to various aspects in social life. In a word, Dujiangyan irrigation system demonstrates the wisdom and creativity of Chinese people and has a universal significance despite the change of time and space. (shrink)

Economic development and mass urbanization have unleashed unprecedented levels of land disputes in East Asia. In China and Vietnam especially, courts and other legal institutions struggle to find lasting solutions. It is against this background of legal failure that this book brings together leading scholars to understand how state agencies, land users and land developers imaginatively engage with each other to resolve disputes. Drawing on empirically rich case studies, contributors explore the limits of law and legal institutions in (...) resolving land disputes and reveal insights into how key actors in East Asia understand land disputes. A workshop sponsored by the American Academy of Arts and Sciences in 1989 brought together more than two dozen scholars in the humanities and social sciences to explore Confucian ethics as a common intellectual discourse in East Asia. The participants included specialists on the societies of China, Japan, Korea, Taiwan, Hong Kong, and Singapore as well as scholars who specialize in comparative studies. In nine intensive sessions, they probed the ways in which the Confucian ethic has shaped perceptions (...) of selfhood, dynamics of familial relations, gender construction, social organization, political authority, popular beliefs, and economic culture in East Asia. This book is a distillation of the essence of their multidisciplinary and cross-cultural examination of these issues. It seeks especially to illuminate claims that Confucian ethics have provided the necessary background and a powerful motivation in the rise of industrial East Asia, the most dynamic region of sustained economic growth and political development since World War II. In the debates on the roles of cultures in the ethics of human rights, one of them concerns Confucianism and Ubuntu, two prominent cultures in East Asia and Southern Africa, respectively. Some scholars assert that both cultures have values that are sharply different from the West, and conclude that the West should learn from these cultures. The aim of this paper is to philosophically investigate the roles of cultures in the ethics of human rights. I first introduce the (...) works of Bell, Metz and others on community values such as relationships and harmony in Confucianism and Ubuntu. I then argue that even if their interpretations were correct, their works still would not justify the conclusion they want. I show that it is better to use consequential evaluation rather than cultural evaluation to justify human rights. An example of human rights to health and privacy is discussed. This paper thus offers some preliminary but important philosophical investigations and addresses practical issues of consequential evaluation related to human rights. Winston Churchill once asserted . In this conception, democracy is , something that is not good but is less bad than its alternatives. This study offers a rigorous test of this concept in the context of East Asia. Analysis of the East Asia Barometer surveys conducted in five new democracies in the region reveals that small minorities of these countries actually perceive the current democratic regime as a lesser evil. A large majority of these , moreover, (...) refuse to support democracy fully. On the basis of these findings, we argue that the Churchillian lesser-evil notion of democracy has limited utility as an alternative paradigm for the study of democratization among ordinary citizens. For decades, scholars and politicians have vigorously debated whether Confucianism is compatible with democracy, yet little is known about how it affects the process of democratization in East Asia. In this book, Doh Chull Shin examines the prevalence of core Confucian legacies and their impacts on civic and political orientations in six Confucian countries: China, Japan, South Korea, Singapore, Taiwan, and Vietnam. Analyses of the Asian Barometer and World Values surveys reveal that popular attachment to Confucian legacies has (...) mixed results on democratic demand. While Confucian political legacies encourage demand for a non-liberal democratic government that prioritizes the economic welfare of the community over the freedom of individual citizens, its social legacies promote interpersonal trust and tolerance, which are critical components of democratic civic life. Thus, the author argues that citizens of historically Confucian Asia have an opportunity to combine the best of Confucian ideals and democratic principles in a novel, particularly East Asian brand of democracy. The papers collected in this volume, although dealing with several different themes, congeal around a debate about the ways and extent of the dominance of linear time and progressive history and the concomitant delineation of the nation in Chinese and Japanese historiography.

It is a great honor to have colleagues engaging in a meaningful discussion of my book. I appreciate my critics’ thoughtful and constructive criticisms as well as exceedingly generous praises. Due to space limitations, I will confine my response to some key issues raised here. I will begin with Yao Xinzhong’s criticism of my claim and argument on the centrality of harmony in Confucian philosophy. Yao reads my view as being that harmony is the central concept or ideal (...) in Confucian philosophy, which I take to mean that harmony has been the central concept or ideal in Confucian philosophy up to this point. In the mid-nineteenth century, Karl Marx issued several critiques of political economy writings stressing the exclusive duality of states and the national economies. He argued that capitalism had characteristic features quite apart from those shaped by the idiosyncrasies of national economies. In the first part of this article, we critique the contemporary state-centered explanations for the industrialization of East Asia on same grounds. We claim that most political economists misinterpret or entirely ignore the significance of export-led industrialization, which (...) is a characteristic feature of East Asian capitalism. In the second part of the article, we demonstrate the importance of the retail revolution in the US and Europe on Asian industrialization. In particular, we show that the development of the sequential ordering system that is an inherent feature of Western-based contract manufacturing differentially shaped the industrial organization of East Asian economies. The resulting path-dependent trajectories of development, in turn, encouraged government policy-makers to ‘buy into’ trends of global capitalism in different ways. The trajectories also led business people to privilege and adapt some social institutions and cultural patterns over other ones. (shrink)

This article sheds light on the diversity of meanings and connotations that tend to be lost or hidden in translations between different conceptualizations of nature in East and South-East Asia. It reviews the idea of “nature” in Chinese, Japanese, Vietnamese, Filipino, Tagalog, Cebuano, Lumad, Indonesian, Burmese, Nepali, Khmer, and Mongolian. It shows that the conceptual subtleties in the conceptualization of nature often hide wider and deeper cosmological mismatches. It concludes by suggesting that these diverse voices need to (...) be represented in global reports on sustainability, which can be fostered by the direct involvement of experts from diverse traditions of thought who have access and interpretative knowledge of sources in languages other than English. To take into consideration the diversity of conceptualizations of nature can lead to better decisions about sustainability and improve the acceptability and efficiency of environmental policies in each local context, as well as internationally. Modern Confucian political philosophy has long been divided between the more comprehensive branch of theories that prioritize Confucian classics and traditions and the more moderate branch of theories that attempt to modernize Confucianism so as to better accommodate contemporary East Asian societies.1 Recently, Joseph Chan and Sungmoon Kim, two leading thinkers from the latter camp proposed their distinct approaches to advocate what for them are the most promising versions of political Confucianism. While Economic and Business Ethics has already attracted increasing attention in East Asia, a comprehensive survey of Economic and Business Ethics has never been done in this region. This study investigates the current status of Economic and Business Ethics as field of teaching, training and research in the East Asia region, particularly in China, Japan, and Korea. Based on multiple approaches that include questionnaire surveys, desktop analysis, and personal observation, this article reports on the current state (...) of training, teaching, and research in the field of Economic and Business Ethics in the three countries. This paper provides an overview of recent literature on the history of epidemics in East Asia, with a primary focus on modern and contemporary China, but including some discussion of the scholarship in English on epidemics in Korea and Japan. Key research strands are identified within the field: local and regional histories, disease biographies, histories of public health campaigns, global connections, and cultural representations. The paper argues that studies of epidemic disease have been central to debates about (...) class='Hi'>East Asian modernity, transformations of the state, the formation of a post-imperial citizenry, postcolonial science and technology studies, and East Asia’s role in globalizing processes. The paper concludes by reflecting on the COVID-19 pandemic and the issues it raises for future research. (shrink)

This article considers how global ethical matters might be approached differently in the English-speaking literature if values salient in sub-Saharan Africa and East Asia were taken seriously. Specifically, after pointing out how indigenous values in both of these major parts of the world tend to prescribe honouring harmonious relationships, the article brings out what such an approach to morality entails for political power, foreign relations and criminal justice. For each major issue, it suggests that harmony likely has (...) implications that differ from approaches that currently dominate Western thought, namely those of utility, autonomy and capability. Lacking the space to systematically defend harmony as a fundamental value, it nonetheless urges theorists not to neglect it in future work. (shrink)

This volume provides a unique overview of methodologies that are conducive to a successful legal transplant in East Asia and Oceania. Each chapter is drafted by a scholar who holds direct professional experience on the legal transplant considered and has a distinctive insight into the pragmatic difficulties related to grafting an alien institution into a legal tradition. The range of transplants includes the implementation of contractual obligations, the regulation of commercial investments and the protection of the environment. The (...) majority of recent legal reforms in these geographical areas have aimed at improving national economic performance and fostering trade and have been directly inspired by European and North American institutional experiences. Edward Said’s concept of Orientalism portrays the high tide of nineteenth-century imperialism as the defining moment in the establishment of a global discursive hegemony, in which European attitudes and concepts gained a universal validity. The idea of “religion” was central to the civilizing mission of imperialism, and was shaped by the interests of a number of colonial actors in a way that remains visibly relevant today. In East and Southeast Asia, however, many of the concerns that statecraft, law, (...) scholarship, and conversion had for religion transcended the European impact. Both before and after the period of European imperialism, states used religion to engineer social ethics and legitimate rule, scholars elaborated and enforced state theologies, and the missionary faithful voiced the need for and nature of religious conversion. The real impact of this period was to integrate pre-existing concerns into larger discourses, transforming them in the process. The ideals of national citizenship and of legal and scholarly impartiality recast the state and its institutions with a modernist sacrality, which had the effect of banishing the religious from the public space. At the same time, the missionary discourse of transformative conversion located it in the very personal realm of sincerity and belief. The evolution of colonial-era discourses of religion and society in Asia since the departure of European imperial power demonstrates both their lasting power and the degree of agency that remains implicit in the idea of hegemony. Spanning the 19th and 20th centuries and identifying multiple waves of modernization, this book illustrates how principles originating in Chinese Confucianism have impacted the modernization of East Asia, especially in Korea. It also analyzes how such principles are exercised at personal, interpersonal and organizational levels. As modernization unfolds in East Asia, there is a rising interest in tradition of Confucianism and reconsider the relevance of Confucianism to global development. This book considers the actual historical significance of (...) Confucianism in the modernization of the three nations in this region, China, Korea, and Japan through the nineteenth century and early twentieth century to the aftermath of the end of World War II. Examining the existing literature dealing with how Confucianism has been viewed in connection with modernization, it provides insight into western attitudes towards Confucianism and the changes in perceptions relative to Asia in the very process of modernization itself. As a fascinating study of global justice in Asia, this book presents a series of contributions reflecting upon the conditions of a greater involvement of East Asian traditions of thought in the debate on global justice. Including chapters on diverse issues such as global social inequalities, human rights practice and the functioning of international institutions, this book examines the political cultures of East Asia in order to help political theorists better appraise the distinctiveness of non‐Western ideas (...) of justice.
